Conditions of Use

The platform (hereinafter "the Marketplace" or "the Platform") acts as an intermediary between professional Sellers (hereinafter "the Sellers") and Customers (hereinafter "the Customers").

 

 

2. Scope

 

2.1 Purpose

These General Terms and Conditions of Use and Sale (GTCUS) govern:

  • Access to and use of the Marketplace

  • The conditions of sale of products or services offered by Sellers

  • The respective responsibilities of the Marketplace, Sellers, and Customers

 

2.2 Acceptance

Any registration or order on the Marketplace implies unconditional acceptance of these GTCUS.

 

2.3 Parties concerned

  • The Marketplace: technical intermediation service provider

  • The Seller: independent professional offering products or services

  • The Customer: consumer or business purchasing via the Platform

 

 

3. The Contract

 

3.1 Formation of the contract

The consumer selects one or more products or services offered by one or more third-party sellers via the marketplace and places them in their virtual shopping cart. The consumer can modify the entered data or the cart contents at any time before final order validation.

 

3.2 Order confirmation

The order becomes firm and final as soon as the consumer clicks the button intended to confirm the order ("Order," "Validate," or equivalent). At that moment, the consumer makes a purchase offer to the concerned sellers.

 

3.3 Acceptance of the offer and contract conclusion

The contract between the consumer and each seller is concluded when the seller accepts the offer, which may be automatic via the platform or after explicit validation. The marketplace acts only as an intermediary and is not a party to the sales contract.

 

3.4 Electronic confirmation

Upon receipt of the acceptance of the offer by one or more sellers, the marketplace promptly sends the consumer an electronic confirmation of the conclusion of the contract(s). The consumer may cancel the order as long as they have not received this confirmation.

 

3.5 Data security

The marketplace takes all necessary technical and organizational measures to ensure the security of electronic data transmissions, including online payments.

 

3.6 Prior verification

Within the legal framework, the marketplace and sellers may conduct checks regarding the consumer's ability to meet payment obligations or other essential elements for contract conclusion. In justified doubt, the marketplace or sellers may refuse an order or impose specific conditions.

 

3.7 Post-contract information

After the contract conclusion, each seller must provide the consumer, in writing or on a durable medium accessible (email, customer space), with the following information:

a) The seller’s visiting address where the consumer can submit complaints;

b) The conditions and modalities for exercising the right of withdrawal, or a clear statement that this right is excluded;

c) Information about after-sales service and applicable warranties;

d) The total price including VAT of products or services, any delivery fees, as well as payment, delivery, or execution terms;

f) The standard withdrawal form if the right of withdrawal applies.

 

3.8 Multiple deliveries

If the order includes multiple deliveries, the information mentioned in the previous paragraph must be provided at the first delivery.

 

 

4. Right of Withdrawal

4.1 General principle

In accordance with Articles VI.47 and following of the Economic Law Code, the Consumer has a fourteen (14) calendar days right of withdrawal without justification or penalties.

 

4.2 Withdrawal periods

For products:

The withdrawal period runs:

  • From the day after the consumer or a third party designated (excluding the carrier) receives the product.

In specific cases:

a. Multiple orders delivered separately: the period runs from the receipt of the last product.

b. Delivery in multiple lots or pieces: the period runs from receipt of the last lot or piece.

c. Regular deliveries of products during a given period: the period runs from receipt of the first product.

For services and digital content not provided on a durable medium:

The period runs from the day after the contract conclusion.

 

4.3 Prior information

If the Seller did not provide the legal information regarding the right of withdrawal or the withdrawal form, the period is extended by twelve (12) months.

Once the Seller provides this information, the Consumer then has 14 days from this communication to withdraw.

 

 

5. Exercise of the Right of Withdrawal and Consumer Obligations

 

5.1 How to exercise

The Consumer exercises the right:

  • Either via the standard form available in their customer account,

  • Or by any clear statement expressing the intention to withdraw.

The Consumer must return or deliver the product to the Seller within 14 days following the communication of the withdrawal decision.

Returns must be made:

  • With all provided accessories,

  • If possible, in the original packaging,

  • Following reasonable instructions from the Seller.

 

5.2 Behavior during the withdrawal period

During this period, the Consumer must handle the product carefully, only to determine its nature, characteristics, and proper functioning, as they could in a physical store.

The Consumer is only responsible for any diminished value if the handling goes beyond what is allowed.

 

5.3 Risks and costs

Return costs are borne by the Consumer unless otherwise indicated by the Seller.

The risk related to return transport is borne by the Consumer.

It is recommended to use a traceable or insured shipping service.

 

 

6. Limits and Exclusions of the Right of Withdrawal

In accordance with Article VI.53 of the Economic Law Code, the right of withdrawal does not apply to:

  • Customized products or those made to order;

  • Perishable goods or goods subject to rapid deterioration;

  • Sealed goods that have been opened after delivery and cannot be returned for reasons of hygiene or health protection;

  • Digital content not provided on a physical medium if the download has started with the explicit consent of the Consumer;

  • Fully performed services with the prior agreement of the Consumer.

For the exclusion to be valid, the Seller must clearly inform the Consumer before the conclusion of the contract.

 

 

7. Effects of Withdrawal

 

7.1. Refund

The Seller shall refund all payments received (including initial delivery costs) no later than 14 days after receiving the withdrawal request, or upon recovery of the goods if earlier.

The refund is made using the same payment method unless the Consumer explicitly agrees otherwise.

 

7.2. Ancillary Agreements

The exercise of the right of withdrawal by the Consumer automatically terminates ancillary contracts, including associated warranties or subscriptions, without additional cost.

 

 

8. Delivery

 

8.1. Role of the Marketplace

The Marketplace acts as a technical intermediary between the Seller and the Buyer. As such:

  • Delivery responsibility lies with the third-party Seller with whom the contract is concluded.

  • The Marketplace commits to ensuring Sellers comply with their delivery obligations according to these terms.

 

8.2. Delivery Address

The delivery location is the address provided by the Buyer when placing the order.

Sellers are not obliged to accept deliveries outside Belgium unless otherwise indicated on their shop page.

If an incorrect or incomplete address is provided by the Buyer, or if delivery fails for reasons attributable to the Buyer (e.g., absence at delivery, inaccessible location), costs related to redelivery or failed delivery will be borne by the Buyer.

 

8.3. Delivery Times

Unless otherwise indicated or agreed:

  • The Seller commits to dispatch the product(s) within 30 days of order confirmation.

  • In case of delay, stock shortage, or impossibility to fulfill, the Buyer will be informed no later than 30 days after order confirmation.

  • The Buyer may then:

    • Accept a new delivery timeframe;

    • Or cancel the contract without cost, with the Seller refunding the full amount within a reasonable time, no later than 14 days.

 

8.4. Transfer of Risks

Risk of loss or damage transfers to the Buyer:

  • Upon actual receipt of the product by the Buyer or a third party designated by them (other than the carrier),

  • Or, if the Buyer selects a carrier not offered by the Seller, upon handing over to that carrier.

Until then, the Seller alone bears transport risks.

 

8.5. Partial Delivery

If an order contains multiple products, they may be delivered separately. Each partial delivery will be notified.

Any non-conforming partial delivery entitles the Buyer to claim according to the article on disputes and guarantees.

 

8.6. Unavailability or Failed Delivery

If delivery cannot be completed due to reasons attributable to the Buyer, the Buyer may:

  • Either collect the parcel at a relay point or depot indicated by the carrier;

  • Or agree to a new delivery attempt (additional costs may apply).

If the parcel is not collected within the specified time, products will be returned to the Seller, who may charge the Buyer for return and redelivery costs.

 

 

9. Payment

 

9.1. Payment Methods

The Marketplace offers a unique set of payment methods valid for all sellers on the platform. These methods are clearly indicated on the site and at the latest at final order validation.

Payments are centralized via the Marketplace, which collects funds on behalf of the sellers.

 

9.2. Due Date and Deadlines

Unless otherwise specified, payment is due immediately at the time of order.

For contracts subject to withdrawal rights (e.g., sale of goods), payment can be deferred until the withdrawal period ends (minimum 14 days).

For services, this period starts the day after order confirmation.

 

9.3. Consumer Obligations

The consumer must provide accurate payment information and notify the Marketplace without delay in case of error or problem.

 

9.4. Late Payment

If payment is not made by the due date, the Marketplace will inform the consumer in writing or electronically, granting an additional 14-day period to regularize.

If still unpaid after this, the amount due will increase by:

  • The legal interest applicable in Belgium,

  • And reasonable out-of-court collection costs, calculated as follows:

    • 15% of the amount due up to €2,500,

    • 10% on the amount between €2,500.01 and €5,000,

    • 5% on the amount between €5,000.01 and €10,000,

With a minimum fixed fee of €40.

The Marketplace reserves the right to apply more favorable conditions to the consumer.

 

9.5. Payment Security

The Marketplace ensures transaction security through certified providers and does not store consumers’ sensitive banking data.

 

 

10. Prices

 

10.2. Variable Prices

Some products or services may be subject to price fluctuations depending on financial markets or other external factors beyond the control of the Marketplace or sellers. These products are clearly identified, with explicit mention that prices are indicative and may vary.

 

10.3. Price Increases Within 3 Months After Contract Conclusion

Price increases within 3 months after contract conclusion are allowed only if resulting from legal or regulatory changes.

 

10.4. Price Increases After 3 Months

After this period, price increases are only possible if expressly stipulated in the contract and:

  • Result from legal or regulatory provisions, or

  • The consumer has the right to terminate the contract at the effective date of the increase.

 

10.5. Geographic Scope and VAT

Prices displayed on the Belgian version of the Marketplace’s website apply only to deliveries in Belgium and include all taxes (VAT included), specifically Belgian VAT.

 

10.6. Delivery Charges

Depending on order value, delivery option, or destination address, delivery fees may be added. These fees will always be transparently and clearly indicated during the order process and included in the “Total Fees.”

 

10.7. Taxes and Import Duties

For deliveries outside Belgium, the consumer may be liable for taxes, customs duties, or other import fees in addition to shipping costs, which only cover product transit. These additional fees are solely the consumer’s responsibility.

 

 

11. Complaints

 

11.1. Complaint Procedure

The Marketplace provides consumers with a clear and accessible procedure to submit complaints regarding contract execution. This procedure is communicated on the website and at order confirmation.

 

11.2. Submission of Complaints

Any complaint concerning a product or service must be addressed to the Marketplace in a complete and detailed manner within a reasonable time from when the consumer noticed the defect or breach.

 

11.3. Response Time

The Marketplace commits to responding to any complaint within 14 calendar days of receipt.

If more time is needed, the Marketplace will acknowledge receipt within this period and inform the consumer of the expected date for a full response.

 

11.4. Attempt at Amicable Resolution

The parties commit to seek an amicable solution within a reasonable time, and no later than 3 months from the complaint date.

The consumer must allow the Marketplace at least 4 weeks to attempt to resolve the complaint before pursuing other procedures.

 

11.5. Dispute Resolution

If no amicable agreement is reached within this timeframe, the dispute will be subject to the dispute resolution procedure described in Article 8 of these general conditions, including the possibility of mediation, arbitration, or competent courts.

 

12 Legal Guarantee and Returns (Belgian Law Compliance)

 

In accordance with Belgian consumer protection legislation (Book VI of the Belgian Code of Economic Law), all products purchased through our marketplace are covered by a 2-year legal guarantee starting from the date of delivery.

What Does the Legal Guarantee Cover?

The legal guarantee applies in the event of any lack of conformity that exists at the time of delivery and becomes apparent within two years. This includes:

  • Manufacturing defects

  • Incorrect or incomplete product descriptions

  • Products that do not function as expected under normal use

 

What Are Your Rights?

If a product is defective or does not conform to the contract, the customer has the right to:

  1. Repair the product, or

  2. Replacement of the product (if repair is not feasible), or

  3. Price reduction or full refund if repair or replacement is impossible or unreasonable.

Returns and Procedure

To report a defect and initiate a return under the legal guarantee:

  1. Contact our customer support with your order number and description of the issue.

  2. Provide photos or evidence of the defect if applicable.

  3. We will guide you through the return process and ensure the product is repaired, replaced, or refunded, depending on the situation.

The return shipping costs related to guarantee claims will be covered by the seller.

⚠️ Exclusions

The legal guarantee does not cover:

  • Damage caused by misuse, neglect, or accidental damage

  • Normal wear and tear

  • Consumables (e.g., batteries, ink cartridges), unless the defect is manufacturing-related

 

13. Disputes

 

13.1. Complaints

The Client first contacts the Seller via the integrated messaging system.

The Seller must respond within a reasonable time (maximum 7 working days).

 

13.2. Marketplace Intervention

In case of no response or deadlock, the Marketplace may intervene as a technical mediator.

 

13.3. Official Mediation

If the dispute persists, the Client may appeal to:

In case of legal proceedings, only the Belgian courts at the Marketplace’s registered office have jurisdiction, unless mandatory provisions state otherwise.
